1. Who we are

We are Four Piece Band LLP (“FPB”, “we”, “us”, “our”), a limited partnership registered in England and Wales under company number OC337584, with its registered office at 7 Sudbrook Close, Wickford, England, SS12 9BN.

2. About these Terms

2.1. These Terms include:

2.1.1. the Terms of Use, which apply to your access to and use of https://travisonline.com (the “Website”) and all its features; and

2.1.2. the Community Rules, which apply when you use the message board available on the Website (the “Message Board”), or any other interactive features of the Website that may be made available from time to time, which enable you to interact with the band Travis (the “Band”) or other users of the Website (each a “User”) (such features are only available to individuals aged 18 or over).

2.2. These Terms do not govern the purchase of goods or services through the Webstore, which are subject to separate terms (see clause 2 of the Terms of Use for more information).

3. Commencement

3.1. By accessing or using the Website, you confirm that you have read, understood and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Website.

3.2. We may revise these Terms from time to time, for example to reflect changes in applicable law or to our Website. You should check these Terms each time you use the Website to ensure you understand the terms that apply at that time. Your continued use of the Website following any changes will constitute your acceptance of the revised Terms.

TERMS OF USE

1. Website

1.1. Subject to these Terms, FPB grants you a limited, revocable, non-transferable and non-exclusive licence to access and use the Website.

1.2. If you provide any feedback, suggestions or testimonials regarding the Website or any services made available through it (together, “Feedback”), you assign to FPB all rights in that Feedback. FPB may use the Feedback for any purpose without restriction and without any obligation to you.

2. Webstore

2.1. Our Website links to an online store (“Webstore”) operated by Townsend Music Ltd (“Townsend”). Your use of the Webstore and any purchases you make through it is subject to Townsend’s own terms and conditions, which are available here: https://travis.tmstor.es/terms.

2.2. Townsend is responsible for the operation of the store, including payment processing, order fulfilment and customer support relating to purchases. FPB does not control and is not responsible for the operation of the store or any transactions made through it.

2.3. You can find more information about how Townsend uses your personal data here: https://travis.tmstor.es/privacy. You should read Townsend’s privacy notice carefully to understand how your personal data will be collected, used and processed by them, and you should not use the Webstore unless you are satisfied with those practices.

3. Restrictions

3.1. You must not:

3.1.1. use the Website in any way that:

3.1.1.1. is unlawful or that would facilitate or promote any illegal activity;

3.1.1.2. would violate any third-party rights, including any intellectual property, privacy or proprietary rights;

3.1.1.3. is abusive, harmful or otherwise objectionable; or

3.1.1.4. would or could cause a material risk to the security or operation of the Website or any third party;

3.1.2. duplicate, modify, disclose or distribute any portion of the Website, or attempt to reverse compile, disassemble, reverse engineer or otherwise reduce to human-perceivable form any of the Website (except as may be allowed by any applicable law which is incapable of exclusion by agreement between the parties) or attempt to do any of the foregoing; or

3.1.3. do or permit to be done anything that would introduce viruses or malicious code into the Website or its systems or the systems of other Users (including exploiting or attempting to exploit any vulnerabilities).

4. Disclaimer of warranties

The Website is provided on an “as is” basis, and FPB makes no express or implied warranty concerning the Website, whether in whole or in part, and FPB expressly disclaims any implied warranties of title, non-infringement, merchantability, and fitness for a particular purpose with respect thereto. Without limiting the generality of the foregoing, there is no guarantee that the Website will meet your requirements, be error free or provided without interruption.

5. Limitation of liability

5.1. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

5.2. We exclude all implied conditions, warranties, representations or other terms that may apply to our Website or any content on it. Access to, and the use of the Website are at your own risk and discretion, and you will be solely responsible for loss or damage arising therefrom.

5.3. We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

5.3.1. use of, or inability to use, our Website; or

5.3.2. use of or reliance on any content displayed on our Website;

even if we have been advised or are otherwise aware of the possibility of such damages.

5.4. In particular, we will not be liable for:

5.4.1. loss of profits, sales, business, or revenue;

5.4.2. business interruption;

5.4.3. loss of anticipated savings;

5.4.4. loss of business opportunity, goodwill or reputation; or

5.4.5. any indirect or consequential loss or damage.

5.5. In any event, our total liability to you for any damages out of or in relation to these Terms (however caused or alleged) will at all times be limited to [£100] in the aggregate irrespective of the existence of multiple claims.

5.6. As noted above, the Webstore is operated by Townsend. Accordingly, FPB is not responsible for the operation of the Webstore or for any purchases, transactions or interactions you have through it. To the fullest extent permitted by law, FPB shall not be liable for any loss or damage arising out of or in connection with your use of the Webstore or any purchases made through it, including any issues relating to payment processing, order fulfilment, delivery, returns or customer support.

6. Indemnity

You agree to indemnify and hold FPB (and its officers, employees and agents) harmless against any third-party damages, claims, actions, proceedings, costs and expenses arising directly from your breach of any term of these Terms or applicable law.

7. Intellectual Property

7.1. “User Content” means any content, material or information that a User creates, uploads, posts, shares or otherwise makes available on or through the Website, including text, images and links.

7.2. Users retain ownership of any intellectual property rights in their User Content.

7.3. By posting User Content, you grant:

7.3.1. to FPB a worldwide, non-exclusive, royalty-free, transferable licence (with the right to sublicense) to use, host, store, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such User Content in connection with operating, promoting, and improving the Website and our services and in the Band’s promotional materials; and

7.3.2. to each other User of the Message Board, a non-exclusive licence to view, use and interact with your User Content in accordance with the functionality of the Website (for example, by reposting or quoting your User Content).

7.4. FPB does not guarantee that any User Content will be kept secure or free from unauthorised access, use or misappropriation by third parties. User Content will be publicly available, and by posting User Content you acknowledge and accept the risks associated with doing so.

8. Non-infringement

8.1. You represent and warrant, in respect of any User Content you submit to FPB (including through the Message Board or any other interactive features of the Website), that:

8.1.1. you own, or have all necessary rights, licences, consents and permissions to submit that User Content and to grant the licences set out in clause 7; and

8.1.2. such User Content does not and will not infringe, breach or misappropriate any applicable law or any third-party rights, including intellectual property, privacy or publicity rights.

9. Privacy and cookies

By using the Website, you confirm that you have read and understood our Privacy Notice and Cookies Policy (available here).

10. Assignment

You may not assign any of your rights or obligations under these Terms to any other person without our prior written consent. We may assign its rights or obligations to associated companies or to any person or entity who may acquire the whole or any part of our business or assets.

11. Term and termination

Without prejudice to any other right or remedy we may have under these Terms or at law, we may terminate your access to the Website (or any part thereof) if you breach these Terms of Use or the Community Rules.

12. Third party rights

These Terms shall be for the benefit of and binding upon both you and FPB and our respective successors and assigns. The rights and benefits of these Terms may be relied upon and enforced by any member of the Band. Otherwise, a person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999.

13. Complaints and disputes

If for any reason a conflict or dispute arises between us in relation to your use of the Website, FPB will endeavour to resolve these informally. If such resolution is not possible and you wish to make a formal complaint, this should be made in writing on a timely basis addressed at first instance to travis@travisonline.com. Your formal complaint will then be investigated internally.

14. Entire Agreement

These Terms constitute the entire agreement between us relating to your use of the Website and supersedes all previous oral or written communications, proposals and agreements in respect thereof. These Terms may not be modified without the express written consent of both parties.

15. Governing law

These Terms shall be subject to English law and the parties hereby submit to the exclusive jurisdiction of the English courts.


COMMUNITY RULES

1. Our Community

1.1. Our Website contains a Message Board that enables Users to interact and develop connections with the Band and other Users by posting and reposting User Content.

1.2. Your use of the Message Board, and any other interactive features of the Website that facilitate interactions between Users, is subject to these Community Rules.

1.3. These Community Rules are designed to enable Users to express themselves and find a community, but not at the expense of others. They do this by setting out the types of User Content and behaviour that are not permitted on the Website.

2. Our Rules

2.1. You must be aged 18 or over to use the Message Board or any other interactive features of the Website. When registering for an account, you will be required to confirm that you meet this requirement.

2.2. You must not use the Website to create, upload, share or otherwise make available any User Content that is illegal or that facilitates illegal activity. To comply with this, you must:

2.2.1. not use the Website in a way that causes, contributes to, or facilitates any of the categories of harm identified in the table below (the “Harms”); and

2.2.2. comply with the specific rules set out below in relation to each Harm (the “Rules”).

Terrorism You must not post, share or link to content that promotes, supports or is connected to terrorist organisations, activities or material.
Child Sexual Exploitation and Abuse You must not post, share, request or link to any content that exploits or abuses children in any way.
Grooming You must not attempt to form relationships with, or communicate in a sexual or exploitative way with, individuals for the purpose of abuse or exploitation.
Child Sexual Abuse Material You must not post, share, request or link to any child sexual abuse material or related content.
Hate You must not post or share content that is abusive, threatening or degrading towards any individual or group based on protected characteristics.
Harassment, Stalking, Threats and Abuse You must not target, threaten, intimidate or repeatedly harass any person, including other Users, the Band or third parties.
Controlling or Coercive Behaviour You must not use the Website to control, pressure or coerce any individual in a harmful or abusive way.
Intimate Image Abuse You must not share, post, request or link to intimate images or content of any person, or send, upload or otherwise make available any unsolicited intimate images or content to other Users.
Extreme Pornography Offence You must not post or link to pornographic content that is illegal or extreme in nature.
Sexual Exploitation of Adults You must not use the Website to exploit, coerce or take advantage of others in a sexual context.
Human Trafficking You must not use the Website to promote, facilitate or be involved in human trafficking or exploitation.
Unlawful Immigration You must not use the Website to promote or facilitate unlawful immigration activities.
Fraud and Financial Services Offences You must not post or share content intended to deceive Users, including scams, phishing links, impersonation or fraudulent ticket sales.
Proceeds of Crime You must not use the Website to handle, promote or facilitate the proceeds of crime, including money laundering.
Drugs and Psychoactive Substances You must not use the Website to promote, supply or facilitate the distribution of illegal drugs or substances.
Firearms, Knives and Other Weapons You must not use the Website to promote, sell or facilitate access to weapons or related materials unlawfully.
Epilepsy Trolling You must not share content intended to trigger physical harm (including flashing images) or target individuals with medical conditions.
False Communications You must not post any false or misleading statements or content, including content that could harm the reputation of any person or organisation.
Obscene Content You must not post or link to any obscene content, including content depicting serious violence, torture or cruelty to humans or animals.
Threats You must not make threats of violence or encourage harm against any person.
Copyright Infringement You must not post or share content that infringes the intellectual property rights (including copyright) of others.
Misuse of Private Information You must not share personal or confidential information about others without their permission.

3. How we protect you

3.1. The design and operation of our Website is intended to limit the risk of illegal content or the specific Harms identified arising. The Website is a small, niche fan forum, which reduces the likelihood and impact of many forms of harm.

3.2. The Website incorporates the following protective features:

Service design and limitations The Message Board is primarily text-based and does not support direct uploading of images or video (other than profile pictures). Private messaging is not available. The Website does not include algorithmic recommendation systems or content amplification features.
User safeguards Users must register with a valid email address and complete verification. Users must confirm they are aged 18 or over before participating. Automated tools are used to detect spam and filter certain keywords and URLs.
Moderation Content is subject to reactive moderation by the Band’s management team. Content that breaches these Terms or is otherwise harmful or unlawful may be removed at FPB’s discretion. Moderation decisions are recorded.
Reporting and escalation Users can report harmful or unlawful content by contacting travis@travisonline.com. Reports are reviewed and escalated internally or to relevant authorities where appropriate.
Ongoing review We regularly review risks and update our moderation processes in light of user reports, moderation activity and regulatory developments.

3.3. FPB reserves the right to monitor, review, remove, or disable access to any User Content at its sole discretion, including where it believes the content breaches these Terms or applicable law.

We cannot guarantee that the Message Board will be free from harmful or objectionable content and Users access it at their own risk. User Content does not reflect the views of FPB and is not endorsed by FPB.

4. Enforcement

4.1. We may take action where we reasonably believe that a User has breached these Terms or where content is unlawful or harmful.

4.2. Actions may include:

4.2.1. removing or restricting access to User Content;

4.2.2. issuing warnings;

4.2.3. suspending or permanently banning accounts;

4.2.4. reporting content or Users to law enforcement or relevant authorities; and/or

4.2.5. preventing repeated breaches, including blocking keywords, links or accounts.

4.3. We apply enforcement measures in a proportionate and consistent manner.

4.4. If action is taken against your content or account, you may contact us at travis@travisonline.com to request information or appeal the decision.

4.5. We may remove content or restrict access without notice where necessary to comply with legal obligations or prevent harm.
